Motorcycle Closeouts, LLC: Policies  (updated 9/16/2007)

CREDIT CARDS
We currently accept VISA, MasterCard and Discover. You will need your credit card number, expiration date, CVV code (on the back) and the billing address where you receive your credit card statement when you place your order. Orders may be phoned in if you prefer, but there is a $5 service charge for telephone orders. To phone in your order or to report problems placing an order, please call customer service at (816) 436-3696 between 10 AM and 5 PM Central.

PAY PAL
Verified buyers using confirmed United States addresses may place orders using PayPal. Using e-Check’s will delay shipment of your order until PayPal notifies us the e-Check has cleared.

ADDRESS VERIFICATION

Orders will not be shipped until we verify your billing address and credit card information. Typically orders are shipped on the same or next business day. We make every attempt to protect our customers and eliminate credit card fraud. Some restrictions may apply. Note: Requesting your order be shipped to your credit card billing address simplifies our verification process and will speed up order processing.

SHIPPING & HANDLING
There are a variety of delivery options available during checkout. AK, HI, APO/FPO and PO Boxes must ship via USPS Priority Mail. Most other orders ship via UPS. Shipping outside of the USA is not available. Shipping and handling rates are based on the total dollar amount of items purchased and are listed below.

Orders received after 10 AM Central Time may not be processed until the next business day.
Economy orders may be delayed a few days by inventory transfers used to minimize shipping costs.
Business Days are defined by UPS as Monday through Friday, except holidays.

Example 1: Premium order placed Wednesday before 10 AM, ships Wednesday, delivered Friday
Example 2: Premium order placed Wednesday after 10 AM, ships Thursday, delivered Monday
Example 3: Express order placed Monday before 10 AM is delivered Thursday or Friday
Example 4: Express order placed Monday after 10 AM is delivered Friday or Monday

Holiday Delays (12/10 - 12/24): Please allow an extra day for shipping during this very busy time.


Should you have any questions regarding delivery options and estimated delivery dates, please e-mail us at help@motorcyclecloseouts.com. We feel our shipping & handling charges are very fair. Don't forget that boxes and packaging material are far from free.

Orders will not be shipped outside the United States. International and Canadian orders cannot be accepted.

SHIPPING & HANDLING EXCEPTIONS
Heavy and/or oversized packages may require additional shipping and handling charges. We will contact you for approval in advance if this is the case.

BACK ORDERS
Sorry no back orders. We would hate to charge you then keep you waiting for an item that may take forever to arrive.

PRODUCT AVAILABILITY
Many of our products are closeout items and therefore are subject to availability. Once a closeout item is gone, it’s gone, so don’t delay when ordering.

We make every effort to keep our inventory figures up to date, but sometimes our inventory or our supplier’s inventory can be off slightly. If a product you purchased is no longer available when pulled for shipment, your credit card will not be charged. We will not ship a partial order without your approval.

If one or more matching apparel items, such as a jersey, gloves and pants set, are out of stock, we will contact you to discuss possible substitute items before shipping your order. We will do our best to find a matching set of quality products for you.

PRICING
NO GAMES! We do our best to bring you the lowest possible prices on closeout and newly released merchandise right up front. We don't start with a high price and make you negotiate or ask for a price match to get a good deal. If you find a lower price on the same product somewhere let us know BEFORE you buy, and we’ll see if we can find a way to reduce our price for all our valued customers.

Occasionally everyone makes an honest mistake; therefore, we apologize in advance for any pricing errors caused by typographical or clerical mistakes and reserve the right to correct them. Because these are honest mistakes, we are not obligated to sell products at erroneous prices. Please let us know immediately if you think an item is mismarked.

MANUFACTURER’S WARRANTY
All products, unless clearly designated as "Blemished," are brand new in their packaging, unused, first-quality products and carry the full factory warranty from the manufacturer. In general, if a product is defective, we will help you work with the manufacturer to resolve the problem. MotorcycleCloseouts, L.L.C. does not warrant any product we sell in any way, but we aren’t happy unless you are happy.

Most manufacturers now prefer to work directly with the customer to resolve warranty claims. Manufacturers have the final say and will repair or replace an item at their discretion. If you feel you have a legitimate warranty claim please feel free to contact us for help, but do not return defective products to us. All returns must be pre-authorized and have a return authorization number attached.

BLEMISHED ITEMS
Blemished items are not usually covered by a manufacturer’s warranty and are sold “AS IS”. If we have any, blemished items will be clearly identified. Many of these products are not actually defective but are dirty, scratched or marred. Every effort will be made to describe and photograph all product defects or problems. Please feel free to contact us to discuss any blemished item in detail before purchasing it.

There are absolutely NO REFUNDS on these one-of-a-kind items. If available, upgrades to a similar, more expensive, blemished or unblemished item will be permitted if the customer pays the price difference and shipping & handling both ways. Returns will not be accepted without a RETURN AUTHORIZATION and are subject to the return policy as described below.

DAMAGED PACKAGE – IMMEDIATE ATTENTION REQUIRED
If a shipment arrives in damaged packaging or appears to have been damaged by the carrier, please notify the delivery person and document the damage with them. Next, please contact our customer service department at (816) 436-3696 with 24 hours, leaving a message if you get our voicemail. Please do not open or unpack the box until you contact us. Opening the box constitutes your acceptance of the package as undamaged from the delivery service.

WRONG, DAMAGED, DEFECTIVE, INCOMPLETE OR MISSING ITEMS – 48 HOURS
If an item(s) you receive from us is wrong, damaged, defective, incomplete or missing you must notify us via e-mail at help@motorcyclecloseouts.com within 48 hours of delivery with a detailed description of the problem. Failure to do so constitutes your acceptance of the item as delivered.

RETURNS AND EXCHANGES – 30 DAYS
We want you to have the right gear in the right size so you'll be happy! If you are in doubt about a product or size, e-mail us before you order at help@motorcyclecloseouts.com for advice from a motorcycle enthusiast.

Returns and exchanges are extremely easy to do at MotorcycleCloseouts and we never charge a restocking fee on your first exchange. Closeout, discontinued and current items can be returned for store credit or a refund; however, all refunds are subject to a refund processing charge. To avoid having your return refused or being charged additional fees your return must meet the following criteria:

  1. A Return Authorization (RA) number must be obtained in advance via email from help@motorcyclecloseouts.com, which lists each item to be returned. Items returned, but not listed on our RA e-mail may be refused.

  2. Returns must be received at MotorcycleCloseouts within 30 days of original shipment to customer. Holiday Extension for items purchased after Thanksgiving: returns must be received by January 15th of the coming year.

  3. For your protection returns must be shipped to the following address via UPS, FedEx or DHL with full insurance and signature required. Return shipments via United States Postal Service will be refused. Returns without the RA# on the label will be refused.

  4. A copy of the complete RA e-mail from MotorcycleCloseouts and a copy of your purchase receipt must be included in the box.

  5. To help ensure your package arrives safely, all returned item(s) must be carefully and securely packed in a generic corrugated cardboard shipping box. Mailer envelopes may be used for small unbreakable items such as t-shirts or MX gloves. The manufacturer’s product packaging (helmet box, boot box, glove bag, etc.) is considered part of the product itself and does NOT constitute a proper shipping box.
    Helmets are delicate and require special care when shipping. Helmets must be inside their protective bag, shield closed, right-side-up in the manufacturer’s box with any and all supplied protective shipping material, including shield protector. The manufacturer’s box should then be placed inside a proper shipping box with protective padding, foam peanuts or packing paper to ensure a snug, secure fit. Helmets returned damaged or scuffed will be refused. Individually packaged helmet face shields must be unopened.

  6. We sure appreciate when returned items and their associated packaging, tags, documentation, etc. are received by us in their original, new, complete, clean, undamaged, unworn and re-sellable condition. When an item is not received in this condition, at our discretion we may refuse the item entirely or deduct cleaning, repackaging or other fees up to 20% of the price of the item from your store credit or refund.

  7. Some items are not eligible for return or exchange including: eyewear, hats, do rags, balaclavas, undergarments, electronics, DVD’s, lighting, and any other items specifically excluded on our web site.

  8. Shipping and handling charges are never refunded or credited to your account. Return shipping is the responsibility of the customer, unless we shipped the wrong item.

  9. Refused items will be shipped back to the customer at the customer’s expense and the item(s) will no longer be eligible for return or exchange. Return shipping and handling on refused items will be $20.00 per item and must be paid by the customer via credit card or PayPal within 14 days of notification. If the return shipping and handling is not paid within 14 days, the customer will forfeit the item(s) and it will be donated to the charity of our choice.

  10. We never charge a restocking fee on the first return/exchange. If you require subsequent returns/exchanges to get the products you need, we will deduct a restocking fee of 10% of the price of each item or $10.00, whichever is greater, from the amount of your store credit or refund.

Please allow us up to 7 days to process your return after it has been delivered. Watch for e-mail notification that your return has been processed.

STORE CREDITS – 365 DAYS
Store credit will be posted to your account at MotorcycleCloseouts.com and can be easily redeemed when you make a purchase online. Your credit will expire and be deleted from our system after 1 year, so don’t forget to use it.

REFUNDS
If you prefer a refund rather than store credit for your returned items, we can refund any balance due to the credit card or PayPal account used to make your purchase. Credit card fees can get expensive and are not refunded to us when we issue a refund. Because of this and the effort required to process a refund, we charge a modest refund processing fee of 10% or $10.00, whichever is greater. This fee will simply be deducted from your refund amount.

EXPRESS EXCHANGES
If you don’t want to wait for us to process your return before you place your replacement order, you can certainly go ahead and do that; however, after we process your return you will have an outstanding store credit. If you would prefer to have a refund for the first item, it will be subject to a modest refund processing fee of 10% or $10.00, whichever is greater. This fee will simply be deducted from your refund amount.

COMBINING/CHANGING ORDERS
Orders may be combined or changed for a $5.00 fee provided we receive and process your request before your order has entered the shipping process. Orders typically enter the shipping process so quickly it is somewhat unlikely we will be able to catch it in time.

CANCELLING ORDERS
You may cancel your order for a $10.00 cancellation fee provided we receive and process your cancellation request before your order has entered the shipping process. Orders typically enter the shipping process so quickly it is somewhat unlikely we will be able to cancel your order. If this is the case, your order will become a return.

PRIVACY POLICY
We do our best to secure all information on our web site. We will not sell or share any of your personal information without your permission. The only exception would be in the case of a drop shipment, where we would provide your name, phone number and mailing address to the shipper/distributor.
